1. Ownership - This site pactr.samrc.ac.za ("Website") is owned and operated by The Pan African Clinical Trials Registry (PACTR) through the South African Cochrane Centre (SACC) and housed at the South African Medical Research Council (MRC).

2. Acceptance of Terms and Conditions - Your access and use of the Website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Website (known collectively as the "Terms and Conditions"). Your use of and/or continued access to the Website constitutes your agreement to the Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use this Website. PACTR may amend the Terms and Conditions at any time by posting the amended terms and conditions on the Website. The amended terms and conditions will be effective immediately and you will be bound by the amended terms and conditions from that time. This agreement may not be amended otherwise. You should visit this page periodically to review the Terms and Conditions. If you violate any Terms and Conditions your right to use and access the Website automatically terminates.

3. Intellectual Property Rights and Restrictions on Use - The Website is available only for your personal, non-commercial use. PACTR retains ownership of all intellectual property rights in and to this Website which is not owned by third parties and any unauthorised use thereof is expressly prohibited. The names of third parties mentioned herein may be the trademarks of their respective owners. PACTR has the right to change or discontinue any feature of the Website including but not limited to the hours of availability and equipment required for access. You may not copy, reproduce, republish, frame, post, upload, distribute, transmit or modify in any way all or any part of the material contained on this Website, unless expressly provided for on the Website or expressly authorised in writing by PACTR. Our Website is available only to, and may only be used by, persons who can form legally binding contracts under their applicable law. Without limiting the foregoing, our services are not available to and may not be used by natural persons under 18 years of age. If you do not qualify, please do not use our services.

PACTR is not responsible for the availability of external sites or resources linked to the Website, and does not endorse and is not responsible or liable for any content, advertising between you and the third party and are not the responsibility of PACTR. Because PACTR is not responsible for the availability or accuracy of these outside resources or their contents, you should review the privacy policies and terms and conditions of these linked sites, as their policies may differ from ours. You access those sites and use their products and/or services at your own risk.

9. Termination - The Terms and Conditions are effective until terminated by PACTR. PACTR may terminate this agreement and your access to the Website at any time without notice. ln the event of termination, you are no longer authorised to access the Website. All restrictions imposed on you, disclaimers and limitations of liability set out in the Terms and Conditions will survive termination.

10. Governing Law - The Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa and you shall submit to the jurisdiction of the South African Courts.

11. Miscellaneous - If any provision of the Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms and Conditions which will continue in full force and effect. Our failure to exercise any particular rights or provision of these terms and conditions shall not constitute a waiver of such right or provision, unless acknowledged and agreed to by us in writing. These terms and conditions, as varied by our ourselves from time to time, sets out the entire understanding and agreement between yourself and PACTR.

12. The PACTR is a Primary Register for the World Health Organisiation (WHO) search portal created by the International Clinical Trials Registry Platform (ICTRP). As a Primary Register the PACTR contributes the minimum 20 item data set to this search portal. All trials registered on the PACTR will therefore be publicly searchable and appear on the WHO search portal.

13. All registered trials on the PACTR are publically available and searchable. The PACTR may make arrangements for information from registered trials to appear on websites other than the PACTR (such as the WHO search portal, see 17. above). This will occur by mutual agreement between the PACTR and the receiving website, with appropriate acknowledgement of the data source.
